derogatory remarks in public places against any particular person without having any substance or materials or proof of that is defamation. can file case in civil as well as in criminal law u/s 499 IPC.

Defamation is both a civil offence as well as criminal offence in India. The remedy for civil defamation is covered under Law of torts. In which, a victim can file a civil suit to seek damages in the form of monetary compensation.
Defamation as a criminal offence is covered under section 499 and 500 of the Indian Penal Code, 1860. The section contemplates that the offence of defamation can be caused only by spoken words or words that are intended to be read or by signs or by visible representation. In the absence of these, a charge of defamation fails. Punishment for the guilty person for criminal defamation is simple imprisonment for a term which may extend to 2 years or with fine or with both.
